TERMS OF SERVICE

OVERVIEW

Welcome to Jon's Tech Repair Centre.

These Terms of Service ("Terms") apply to your use of our website, online store and any related services, products and repair services provided by Jon's Tech Repair Centre ("we", "us", "our" or "Jon's Tech Repair Centre").

Our website and online store are powered by Shopify, which provides the technology that enables us to offer our online services.

By accessing or using our website, placing an order, purchasing a product or booking a repair with us, you agree to be bound by these Terms, together with any other policies referred to within them, including our Privacy Policy and Refund/Returns Policy.

Please read these Terms carefully before using our website or purchasing from us. If you do not agree with these Terms, please do not use our website or services.


SECTION 1 – ACCESS AND ACCOUNT

You must be at least 18 years old to enter into a contract with us unless you are using our services with the involvement or consent of a parent or legal guardian where permitted by law.

When placing an order or using our services, you may be required to provide information including your name, email address, billing address, delivery address, telephone number and payment details.

You agree that all information you provide to us is accurate, complete and up to date.

If you create an account with us, you are responsible for keeping your login details secure and for all activity carried out through your account.

You must not sell, transfer or otherwise allow another person to use your account.


SECTION 2 – OUR PRODUCTS AND REPAIR SERVICES

We make every reasonable effort to ensure that product descriptions, photographs, specifications and pricing displayed on our website are accurate.

However, colours and appearance may vary depending on your device, screen settings and other technical factors.

Where products are pre-owned, refurbished or graded, the condition of the item will be described as accurately as reasonably possible. Any known cosmetic marks, wear, faults or other relevant condition information will be disclosed in the product listing where applicable.

For second-hand and refurbished electronic devices, battery health, battery cycles and cosmetic condition may vary unless specifically stated in the individual product description.

We reserve the right to update product descriptions, prices, specifications and availability where necessary.

Repair services are subject to the specific repair description, quotation or agreement provided to the customer.

Where a repair requires additional work that was not included in the original quotation, we may contact you before carrying out additional chargeable work.


SECTION 3 – ORDERS

When you place an order through our website, you are making an offer to purchase the product or service selected.

Your order will be subject to our acceptance and availability of the relevant product or service.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • A product is unavailable.

  • There has been an obvious pricing or description error.

  • We reasonably suspect fraudulent or unauthorised activity.

  • The product has been incorrectly listed.

  • We are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been taken, we will arrange an appropriate refund.

You should carefully check your order before submitting it.

Your statutory rights as a consumer are not affected by these Terms.


SECTION 4 – PRICES AND PAYMENT

All prices displayed on our website are shown in pounds sterling (£) unless otherwise stated.

We reserve the right to change prices, discounts and promotional offers at any time. The price applicable to your order will normally be the price displayed at the time your order is placed.

Where applicable, delivery charges and other additional charges will be displayed before you complete your purchase.

Payment must be successfully received before an order can be processed or dispatched unless otherwise agreed.

We accept the payment methods made available through our website.

If a payment is declined or reversed, we may delay or cancel the relevant order until payment has been successfully received.


SECTION 5 – SHIPPING AND DELIVERY

We will provide estimated delivery times where applicable.

Delivery dates and times are estimates and may be affected by circumstances outside our reasonable control, including courier delays, adverse weather, strikes, technical problems or other events beyond our control.

We will make reasonable efforts to dispatch orders within the timeframe stated on our website or in your order confirmation.

Risk in products will pass in accordance with applicable UK consumer law.

If your order arrives damaged, you should contact us as soon as reasonably possible and provide photographs or other relevant information where requested.

Nothing in these Terms limits or excludes any rights you have under UK consumer law.


SECTION 6 – RETURNS, REFUNDS AND CONSUMER RIGHTS

Our returns and refund arrangements are set out in our separate Refund/Returns Policy.

Nothing in these Terms is intended to remove or restrict any statutory rights you may have under applicable UK consumer protection legislation.

Where you purchase goods as a consumer, you may have rights relating to goods that are faulty, not as described, not fit for purpose or otherwise fail to meet the requirements of applicable law.

Where a legal right to a refund, repair, replacement or other remedy applies, we will comply with our obligations under applicable law.

For online purchases, additional cancellation rights may apply under the Consumer Contracts Regulations 2013, subject to applicable exceptions.

Certain products or services may be exempt from cancellation rights where permitted by law.


SECTION 7 – REPAIRS

Before carrying out a repair, we may provide an estimated or quoted price.

Repair prices may change if additional faults or damage are discovered once the device has been inspected.

We will seek customer approval before carrying out additional chargeable work where reasonably practicable.

Customers should back up important data before handing a device to us for repair.

Although we take reasonable care of customer devices, customers are responsible for maintaining their own backups.

We are not responsible for loss of data where such loss occurs during or as a result of a repair, unless liability cannot legally be excluded or limited.

Where a repair warranty is provided, the length and terms of that warranty will be stated at the time of purchase or repair.

Our repair warranty does not affect your statutory consumer rights.


SECTION 8 – TRADE-INS AND PART EXCHANGE

Where we agree to purchase or accept a device, game, console, computer or other item from you, the value offered may depend upon its condition, specification, functionality, accessories and market value.

Any valuation provided before physical inspection may be subject to change following inspection.

We reserve the right to refuse a trade-in or part exchange where we reasonably believe that the item is unsuitable, defective, counterfeit, stolen or otherwise cannot lawfully be accepted.

Customers may be required to provide identification or other information where required by law or our internal procedures.


SECTION 9 – INTELLECTUAL PROPERTY

All content on our website, including text, photographs, graphics, logos, branding, product descriptions and other materials, belongs to Jon's Tech Repair Centre or the relevant third-party rights holder.

You must not reproduce, copy, modify, distribute, sell or commercially exploit our website content without our prior written permission, except where permitted by law.

All third-party trademarks, product names and logos remain the property of their respective owners.

SECTION 11 – SHOPIFY

Our online store is powered by Shopify.

Shopify provides the online commerce platform that allows us to sell our products and services.

However, your purchase is made directly from Jon's Tech Repair Centre and not from Shopify.

Shopify is not responsible for the products or services purchased from Jon's Tech Repair Centre.


SECTION 12 – PRIVACY

Your personal information is handled in accordance with our Privacy Policy.

By using our website or purchasing from us, you acknowledge that you have read and understood our Privacy Policy.

We may share necessary information with service providers, payment processors, delivery companies and other third parties where required to process your order, provide our services, comply with legal obligations or protect our legitimate interests.

You must not submit content that is unlawful, defamatory, threatening, abusive, fraudulent, misleading or infringes another person's rights.

We reserve the right to remove content that breaches these Terms or applicable law.

Nothing in this section affects your statutory rights or prevents you from giving an honest review of your experience.

Occasionally our website may contain typographical errors, incorrect pricing, inaccurate descriptions or other errors.

We reserve the right to correct such errors and update information where necessary.

Where an obvious error affects an order, we may contact you before fulfilling the order.

If an order is cancelled because of an error, any payment taken for that order will be refunded.

Nothing in these Terms affects your statutory rights as a consumer.

Subject to the above, we will not be responsible for losses that were not reasonably foreseeable at the time the contract was entered into.

We do not accept responsibility for losses caused by circumstances outside our reasonable control.

For repair services, customers should maintain appropriate backups of important data before providing a device to us.


SECTION 18 – SEVERABILITY

If any part of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or modified to the minimum extent necessary.

The remaining provisions will continue to apply.


SECTION 19 – ENTIRE AGREEMENT

These Terms, together with any policies specifically referred to within them, form the agreement between you and Jon's Tech Repair Centre in relation to your use of our website and services.

Any specific written quotation, repair agreement or other terms provided to you for a particular transaction may also apply.

Where there is a conflict between these Terms and your statutory consumer rights, your statutory rights will take precedence.


SECTION 20 – CHANGES TO THESE TERMS

We may update these Terms from time to time.

The most current version will be made available on our website.

Changes will generally apply from the date they are published and will not retrospectively remove rights that you have already acquired.


SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of England and Wales.

If you are a consumer, you will retain any mandatory protections provided to you by the laws applicable to your place of residence where required by law.

Any disputes will be dealt with by the courts having appropriate jurisdiction under applicable law.
